MEDICO-LEGAL case studies 03 Critical of care: defending your reputation Most doctors will have a patient die while under their care at some point in their career. Even good doctors can be criticised during a coronial inquest and need good representation to protect their reputation. 06 Private lives: relationship boundaries Many doctors come to know their patients well and may even be friends or acquaintances, particularly in more rural and remote communities. Being too close can make it difficult to identify the fine line between what is deemed acceptable and going too far. 08 Questioning questions: clarifying the purpose Communication between doctor and patient can be challenging and easily lead to complaints with doctors unnecessarily going before regulators. In this case our member had to justify to the Medical Board why he asked a patient a particular question. 10 We're going ahead: treatment conundrums It is a natural tendency for doctors to want to provide the best treatment for their patients. Going ahead with what you think is best may require some further consideration to avoid a subsequent complaint. 12 It's personal: colleague's complaint Maintaining positive relationships with colleagues is as important, and sometimes as challenging, as it is with patients. This case demonstrates how stress impacts doctors and can lead to further anxiety. 14 The hardest word: saying sorry matters Every doctor will face situations where treatment doesn't go as well as planned, whether it's an inherent risk or an error of some kind. How the adverse event is handled can make a big difference to the impact for the patient and the treating team, as these cases demonstrate. 18 Hospital headaches: workplace demands Relationships in the workplace are manyfold and complex.
